The terms that govern our excavation services.

These Terms of Service ("Terms") govern the services provided by TC Contracting ("we", "us", or "our") to you ("the Client"). By engaging our services, you agree to these Terms.
Services
TC Contracting provides mini excavation, trenching, grading, concrete breaking, augering, soil removal, driveway work, and related contracting services for residential and commercial properties in the Greater Victoria area, British Columbia.
The specific scope of each project will be outlined in the written quote provided before work begins.
Quotes & Estimates
All quotes are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the site conditions observed during the assessment visit. If site conditions differ materially from what was observed (e.g., hidden concrete, unexpected rock, utilities not disclosed), the scope and cost may be adjusted.
We will communicate any changes to the scope or pricing before proceeding with additional work.
Scheduling & Cancellation
Once a quote is accepted and a start date is agreed upon, we will make every reasonable effort to begin and complete the work on schedule. Weather, equipment issues, or unforeseen site conditions may require schedule adjustments.
If you need to cancel or reschedule, please contact us at least 48 hours before the scheduled start date. Cancellations with less than 48 hours notice may be subject to a cancellation fee to cover mobilization costs.
Payment Terms
Payment terms will be outlined in the quote and agreed upon before work begins. Standard terms include:
- Payment is due upon completion of work unless otherwise arranged
- For larger projects, a deposit may be required before work begins
- We accept e-transfer, cheque, and cash
- Outstanding balances beyond 30 days may be subject to interest
Site Access & Preparation
The Client is responsible for:
- Providing clear access to the work area
- Identifying any known underground utilities, irrigation, or other obstacles
- Ensuring pets and children are kept clear of the work area during operations
- Obtaining any required permits (we can advise on what may be needed)
TC Contracting will call BC One Call before any excavation work to locate underground utilities as required by law.
Liability
TC Contracting carries appropriate liability insurance for our operations. We take reasonable care to protect your property during the course of our work. However:
- We are not liable for damage to underground utilities, structures, or other items not disclosed or not reasonably discoverable before work begins
- Minor surface disturbance (lawn, soil compaction from equipment movement) is a normal part of excavation work and is not considered damage
- We are not responsible for pre-existing conditions such as failing retaining walls, cracked foundations, or deteriorated landscaping that may be affected by nearby excavation
Warranty
TC Contracting stands behind the quality of our work. If you are not satisfied with the completed work, contact us within 14 days and we will assess and address any legitimate concerns at no additional cost.
This warranty does not cover issues arising from normal settlement, third-party modifications to our work, or conditions beyond our control (e.g., flooding, extreme weather).
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through direct communication. If the dispute cannot be resolved informally, it shall be settled through mediation or arbitration in accordance with the laws of British Columbia.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
